Did you blink? If so, you might have missed the spanking the National Labor Relations Board (NLRB) just took at the hands of the D.C. Circuit Court of Appeals. The NLRB has been told to back off until further notice. Seems the Court and the Board have different ideas of just how far the Board can reach into your workplace.
As our already over-burdened court system is once again taxed with a NLRB issue, you can be sure the Board will be busy filing an appeal.
Either way, employers can file those notices under “someday”.
