OSHA Penalties Are Increasing Starting January 15, 2021

Industry Update: 

OSHA’s civil penalty levels for any workplace safety or health violation assessed after January 15, 2021 are increasing. This increase is in accordance with cost-of-living adjustments for 2021.

 

Please note the following changes:

  • Maximum penalties for willful or repeated violations will increase from $134,937 to $136,532 per violation.
  • Maximum penalties for serious and other-than-serious violations are increasing from $13,494 per violation to $13,653 per violation.

 

In regard to states with their own Occupational Safety and Health Plans:

  • You must adopt maximum penalty levels that at least match these federal levels.
